Easement, Covenant & Land Title Surveys

Relating to new or existing parcels of land

Many existing sections have rights or restrictions attached to them. If you wish to cross another person’s land to access your own, or have your services (eg water, sewage, storm-water, electricity, telecommunications, etc) crossing another person’s land, an Easement will have to be surveyed and created.

If you wish to have a restriction on the use of a portion of your land (eg a limit on the building height) a Covenant can be created. Easements and Covenants are created for many purposes, but, to be legally enforceable, they must be registered on your Certificate of Title. A new Easement or Covenant survey is generally required to be prepared, and approved by Land Information New Zealand, prior to registration on the Certificate of Title.
